Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Training Calibration ("Company," "we," "us," or "our"), operated by Josh [Last Name], located in Gulf Shores, Alabama, governing your access to and use of the Training Calibration macro calculator tool and any related products, content, or services available at www.trainingcalibration.com (the "Service").

By accessing the Service, completing a purchase, or clicking any "I Agree" or equivalent button, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you may not access or use the Service.

You represent that you are at least 18 years of age. If you are under 18, you may not use the Service without the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

The Service

Training Calibration provides a web-based macro and calorie calculator tool designed to help users estimate Total Daily Energy Expenditure (TDEE) and set personalized macronutrient targets based on inputs including but not limited to body weight, age, activity level, metabolic tier, training volume, and goal selection (the "Tool").

Nature of the Tool

The Tool is designed as an estimation and planning aid. Outputs produced by the Tool — including calorie targets, macro splits, and TDEE calculations — are estimates based on user-provided inputs and established nutritional and physiological formulas. Results may vary based on individual metabolic differences, health conditions, and other factors not captured in the Tool's inputs.

The accuracy of Tool outputs is directly dependent on the accuracy of the inputs you provide. Training Calibration makes no guarantee that Tool outputs will produce specific physical results.

Access

Upon completing a valid purchase, you are granted a non-exclusive, non-transferable, limited right to access and use the Service for personal, non-commercial purposes in accordance with these Terms. This is a one-time purchase of access — not a subscription. Your access does not expire for the purchased tier unless the Service is discontinued, in which case reasonable notice will be provided.

Availability

We make reasonable efforts to maintain the availability and functionality of the Service. However, we do not guarantee uninterrupted access and reserve the right to perform maintenance, updates, or modifications at any time. We will not be liable for any downtime or temporary unavailability of the Service.

Purchases & Payment

Purchase Tiers

Training Calibration offers one-time purchase access to the macro calculator tool at one or more pricing tiers (Standard and Pro, as currently offered). Each tier includes specific features and resources as described at the time of purchase on the product page.

Payment Processing

All transactions are processed through third-party payment processors. By completing a purchase, you agree to the payment processor's terms of service and authorize the applicable charge to your selected payment method. Training Calibration does not store full credit card or payment information on its servers.

Pricing

All prices are listed in U.S. dollars. We reserve the right to modify pricing at any time. Price changes will not affect purchases already completed.

Purchase Confirmation

Upon successful payment, you will receive a confirmation email at the address provided at checkout. This email constitutes your receipt. If you do not receive a confirmation within 24 hours, please contact us at [email protected].

Refund Policy

Because the Training Calibration Tool is a digital product that is immediately accessible upon purchase, all sales are generally final and non-refundable once access has been granted.

We reserve the right to approve or deny refund requests at our discretion. Change of mind, failure to use the Tool, or dissatisfaction with self-reported results that are attributable to inaccurate user inputs do not qualify as grounds for a refund.

Health & Medical Disclaimer

Before beginning any new nutrition plan, exercise program, or making significant changes to your diet, you should consult with a qualified healthcare provider, particularly if you:

• Have or suspect you have any medical condition, including metabolic disorders, diabetes, cardiovascular disease, eating disorders, or hormonal conditions
• Are pregnant, nursing, or planning to become pregnant
• Are under the age of 18
• Are currently taking prescription medications
• Have a history of disordered eating

The macronutrient and calorie outputs generated by the Tool are estimates based on widely used physiological formulas and user-provided inputs. Individual results will vary based on genetics, health status, adherence, training quality, and other factors outside the Tool's scope.

Training Calibration does not diagnose, treat, cure, or prevent any disease or health condition. Use of the Tool is entirely at your own risk.

Intellectual Property

All content on the Training Calibration website and within the Service — including but not limited to the calculator methodology, program documents, written content, design, graphics, logos, and the "TC" mark — is the exclusive intellectual property of Training Calibration and its owner, and is protected by applicable copyright, trademark, and trade secret laws.

What You May Do

• Access and use the Tool for your own personal, non-commercial nutrition planning
• Download or print program materials (Pro tier) for your own personal use
• Share your personal output results (e.g., your calculated macros)

What You May Not Do

• Copy, reproduce, distribute, sell, resell, or publicly display any portion of the Service or its content
• Use the Tool's methodology or outputs to build, train, or inform a competing product or service
• Share purchased program documents with others or distribute them in any form
• Reverse engineer, decompile, or attempt to extract the underlying calculation logic of the Tool
• Claim authorship of or remove any proprietary notices from any content

Unauthorized use of Training Calibration intellectual property may result in termination of your access and may subject you to legal action.

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates applicable federal, state, or local laws or regulations
• Attempt to gain unauthorized access to any portion of the Service, its servers, or related systems
• Transmit any malicious code, viruses, or disruptive data to the Service
• Use automated means (bots, scrapers, crawlers) to access or collect data from the Service
• Misrepresent your identity or affiliation in connection with use of the Service
• Use the Service on behalf of others in a commercial coaching capacity without written permission from Training Calibration

We reserve the right to terminate or restrict access to any user who violates these acceptable use provisions without refund.

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TRAINING CALIBRATION EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

TRAINING CALIBRATION DOES NOT WARRANT THAT: (A) THE SERVICE WILL MEET YOUR REQUIREMENTS; (B) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS OBTAINED FROM USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE; OR (D) ANY ERRORS IN THE SERVICE WILL BE CORRECTED.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRAINING CALIBRATION, ITS OWNER, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT WILL TRAINING CALIBRATION'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE AMOUNT YOU ACTUALLY PAID TO TRAINING CALIBRATION IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

The foregoing limitations apply whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, and even if Training Calibration has been advised of the possibility of such damages.

Indemnification

You agree to defend, indemnify, and hold harmless Training Calibration, its owner, affiliates, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of or access to the Service
• Your violation of these Terms
• Your violation of any applicable law or third-party rights
• Any content or data you submit to the Service

Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. For significant changes, we may also provide notice via email to the address associated with your purchase.

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of the Service.

Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service that cannot be resolved informally shall be submitted to binding arbitration in Baldwin County, Alabama under the rules of the American Arbitration Association (AAA), except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction where necessary to protect intellectual property rights or prevent irreparable harm.

You waive any right to participate in a class action lawsuit or class-wide arbitration against Training Calibration.
